AFFIDAVIT
In support of Motion
For Leave to Appeal Informa Pauperis
Now Joe Louis Lawrence, Counsel Pro Se, Appellant in
this cause files herewith his affidavit as required by Title 28, United States
Code states:
1.) That Judge
Darrah and many of his Brethern have become complicit in an “Organized Conspiracy” as
Trespassers of the laws, pursuant to Page
8, Par. H of Gr Ex A, states “The Seventh Circuit of Appeals held that
the Circuit Court of Cook County is a criminal enterprise.” U. S. v. Murphy, 768 F. 2d 1518, 1531 (7th Cir.
1985) Said judges who authored this precedent was Frank H. Easterbrook,
Richard D. Cudahy and former Chief Judge Luther Merritt Swygert;
A- Said Judge and
his brethren had no authority or jurisdiction to deny Appellant access to the Federal
Tribunal in waiving all fees due to his pauperis status, but because of his
skin color and the magnitude of racial hatred lodged at him said judge
committed Treason, see Page 10, Par 2 “whenever a judge acts where he/she does not have jurisdiction to act,
the judge is engaged in an act or acts of treason”. U. S. v. Will, 449
U. S. (6 Wheat), 264, 404, 5L Ed 257 (1821)
B- For any judge
to see a blank (Dec. 12, 2016) court order not signed and move forward like
nothing is wrong is indicative to how the Democratic judges in Illinois engage
in “untouchable” Arrogance engaging in Treason undermining the United States
Constitution enforcing racial hatred rulings from the bench;
C- That
because of the overwhelming control Democrats have over the entire legal system
it is impossible for any person of color or Republican to ever receive justice
in this racist segregated legal system, hereto attached, Page 1, of the
Petition to Transfer to Another Judicial Council;
D-
That said Dec. 12, 2016 order is void; The United States Supreme Court has stated that “if a court
is without authority; its judgments and orders are regarded as nullities.”
Elliot v. Piersol, 1 Pet. 328, 340, 26 U.S. 328, 340 (1828). They
are not voidable, they are simply void and form no basis for alleging judicial
immunity. When a judge acts as a trespasser of the law or when he does not
follow the law, he loses subject matter jurisdiction and all of his orders are
void or have no recognizable legal force or effect.
2.) That Judge
Darrah is relying on all of his Brethren to continuously War against the United States Constitution in that they do
not fear the laws of the United States Constitution or the President because of
their skin color being white, they are untouchable in that they are challenging
the Federal government to exercise its authority to eradicate them from power,
in that, said acts are a norm in Chicago, Illinois Black and Brown lives don’t
matter and they (judges) decide who’s lives may matter when upholding criminal
acts of the fraternal membership;
3.) That Page
9, Par. 10, states, “No state
legislator or executive or judicial officer can war against the Constitution
without violating his undertaking to support it” Cooper v. Aaron, 358
U.S. 1, S. Ct. 1401 (1958)
4.) Appellant is
existing indigently on welfare due to “powerful
racist corrupt white men” in power known as the Political Machine, Ku Klux Klan
said individuals have exhausted diabolical evils surpassing human imagination
upon Plaintiff and his families for standing up to Racial Apartheid Injustice
in the courts, because they were not able to incarcerate him they have elected
to Lynch him on paper demonstrating an active War against the United States
Constitution as many in responsible authority did nothing, Page 8, Par H, states, “Since
judges who do not report the criminal activities of other judges become
principals in the criminal activity, 18
U.S.C. Section 1, and since no judges have reported the criminal activity
of the judges who have been convicted, the other judges are as guilty as the
convicted judges”
FURTHER AFFIANT SAYETH NAUGHT
WHEREFORE
APPELLANT PRAYS That a Circuit Judge preside over this matter not subject to
the Judicial Council Complaint alternatively transfer this matter to another
Circuit;
WHEREFORE
APPELLANT PRAYS That this Circuit recognize the District Courts Order as a
Nullity and Issue Rules to Show Cause Remanding every attorney and judges
complicit in Warring against the United States Constitution as they perpetrated
hate crimes et al. against the Appellant;
Wherefore
alternatively invoke any other remedy necessary upholding Appellants Civil
Rights under the United States Constitution expediting any relief Instanter due
to his homeless status, seeking $37.9 Million Dollars for the Complaint
before Judge Darrah as punitive damages; Smith v. Wade, 461
U.S. 30, 35, 103 S. Ct. 1625, 1629, 75 L Ed 2d 632 (1983) Justice Brennen “The threshold standard for
allowing punitive damages for reckless or callous indifference applies even in
a case, such as here, where the underlying standard of liability for
compensatory damages because is also one of recklessness. There is no merit to
petitioner’s contention that actual malicious intent should be the standard for
punitive damages because the deterrent purposes of such damages would be served
only if the threshold for those damages is higher in every case than the
underlying standard for liability in the first instance. The common-law rule is
otherwise, and there is no reason to depart from the common-law rule in the
context of {1983}”
