![]() | MINUTE entry before the Honorable John Robert Blakey: Plaintiff has moved for default as to Defendants Equifax and Verizon, see27 , and for default judgment,26 . The Court denies both motions26 ,27 and strikes the 12/3/25 Notice of Motion date. Default remains inappropriate as to Defendant Equifax, which has appeared and answered, see15 ,17 ,18 . And default also remains inappropriate as to Verizon because Plaintiff's submissions do not demonstrate service in compliance with Rule 4. Plaintiff's proof of service indicates that he served Verizon via certified mail, see6 . But neither Rule 4(h), nor any other section of Rule 4, allows a plaintiff to serve a private domestic corporation by certified mail. Nor does Illinois law provide for service by certified mail. See 735 ILCS 5/2204. Instead, Rule 4(h) provides that, unless federal law provides otherwise or the defendant's waiver has been filed, "a domestic or foreign corporation, or a partnership or other unincorporated association that is subject to suit under a common name, must be served: (1) in a judicial district of the United States: (A) in the manner prescribed by Rule 4(e)(1) for serving an individual; or (B) by delivering a copy of the summons and of the complaint to an officer, a managing or general agent, or any other agent authorized by appointment or by law to receive service of process and--if the agent is one authorized by statute and the statute so requires--by also mailing a copy of each to the defendant; or (2) at a place not within any judicial district of the United States, in any manner prescribed by Rule 4(f) for serving an individual, except personal delivery under (f)(2)(C)(i)." Rule 4(e)(1) does not authorize service by certified mail. The Court previously ordered Plaintiff to file a status report concerning service on Verizon by 12/3/25, and hereby extends that deadline to 12/19/25; the Court also extends the deadline for the parties' joint status report to 12/29/25. If Plaintiff declines to participate in the preparation and filing of a joint status report, the Court will dismiss the case for failure to comply with a court order and failure to prosecute. Mailed notice. (evw, )
